Terms of Service

Agreement
- By commissioning me, you (the "Client") agree to the following Terms of Service. Please read them carefully.Commission Process- Communication: Primary communication will be via [Twitter, Reddit, Email, etc.]. I strive to respond within 48 hours.- Client Queue: If there are clients ahead of you, you will be placed on a waitlist. I will notify you of your estimated start date.- Client Responsibilities: To begin, the Client must provide clear references and a detailed description of the desired artwork, including character design, pose, style, and any other important elements.Payment & Pricing- Currency & Method: All payments are to be made exclusively on VGen.- Pricing: Prices are fixed upon agreement and are non-negotiable.- Commercial Use: All artwork is for personal, non-commercial use unless a Commercial License is purchased. Commercial projects will incur a significant price increase, as detailed in the pricing section. Unauthorized commercial use is prohibited.- Payment Schedule: A 50% non-refundable deposit is required to begin work. The remaining 50% is due upon completion and before the final high-resolution files are delivered.Timeline & Delivery- Estimated Completion: The standard completion time is estimated to be between a few days to at most, a month from the project's start date. This is an estimate and may vary based on complexity, my workload, and the Client's responsiveness during the review stages.- Updates: I will provide progress updates at key stages: rough sketch, rough color, and pre/mid-render. The Client is also welcome to request a status update at any time.Revisions & Changes- Sketch Stage: Major revisions (e.g., composition, pose, core concept) are free and encouraged at the initial sketch/colored sketch stage.- Later Stages: The client is free to ask for progress after the initial sketch. Revisions at this point will incur an additional fee, to be discussed and agreed upon before work continues.- Minor Adjustments: Minor adjustments (e.g., color tweaks, small accessory additions) and corrections of errors on my part will be made at no extra cost.Cancellation & Refund Policy- By the Artist: I reserve the right to decline or cancel a commission at any time for any reason, including discomfort with the request or unforeseen circumstances. If I cancel, the Client will receive a full refund of any amount paid.- By the Client:If the Client cancels before work has begun, a full refund will be issued.If the Client cancels after work has begun, the 50% deposit is non-refundable as it compensates for time and labor already invested.No refunds will be issued after the final payment has been made and the final files have been delivered.Rights & Usage- Artist Rights: I, the Artist, retain all copyright and intellectual property rights to the commissioned artwork. This includes the right to display, distribute, reproduce, and use the artwork for self-promotion in my portfolio, social media, prints, etc.- Client Rights:- Personal Use: The Client receives the right to use the artwork for personal, non-commercial purposes (e.g., avatars, wallpapers, printing for personal display). The Client may not claim the artwork as their own creation or alter it without my permission.-Commercial Use: A commercial license grants the Client the right to use the artwork for profit (e.g., merchandise, promotional material, logos). Terms will be specified in a separate agreement. The Artist still retains the copyright.- Credit: The Client is encouraged but not required to credit me when posting the artwork online. I will always credit the Client if they are the subject/owner of the original character, unless they request anonymity.
